The contractor is an IT service provider with extensive experience in providing document processing devices and full-service services. The contractor assumes overall responsibility for the functionality and full integration capability of the document processing devices into the existing and planned IT landscape of the contracting authorities. Likewise, it ensures the operational safety of the document processing devices and guarantees their operational readiness within the specified timeframe. The place of performance for all services is the locations of the contracting authorities, which will be named in the respective call-off from the framework agreement. All main locations of the contracting authorities are connected to each other via a fiber optic network. A main print server with Win 2022 is installed on-site. All desktop PCs and laptops work with Windows 11 64bit. All PC workstations must be equipped with MS Office 365, standard third-party software, the Orbis clinical information system, Meditec, and various printing software. All services are provided according to the specifications of the MZG free of charge. The transport risk is borne by the contractor. Transport and packaging materials must be removed immediately upon delivery from the user's premises upon request and recycled/disposed of in an environmentally friendly manner; intermediate storage is not possible. The contractor is responsible for the organization and costs of return and disposal. No additional fee will be charged for the aforementioned services; the corresponding costs are included in the offer prices. The framework agreement has a term of 48 months. A contract extension is not planned. Call-offs from the framework agreement will be triggered in writing by the contracting authorities in the form of an order. Since personal data within the meaning of Art. 4 No. 1 of the General Data Protection Regulation (GDPR) will be processed in the execution of the framework agreement, the contractor must commit to complying with the applicable data protection regulations of the European Union (esp. the GDPR), the Federal Government (Federal Data Protection Act - BDSG), and the state of North Rhine-Westphalia (Data Protection Act North Rhine-Westphalia - DSG NRW). For this purpose, it will conclude a contract for order processing according to Art. 28 GDPR with the contracting authorities. Based on the framework agreement, the contracting authorities can call off individual orders for the rental of document processing devices, including the associated serviceleistungen, during its term (hereinafter referred to as "individual order").
