NOTICE
The following construction work ordered by Matsumae Town will be contracted through the post-bid examination type general competitive bidding method. We hereby announce the necessary qualifications for bidders and other information, in accordance with the provisions of Article 167-6, Paragraph 1 of the Local Autonomy Act (Cabinet Order No. 16 of 1947).

1. Items for Bidding
(1) Bid Number: No. 1-39
(2) Bid Name: Reiwa 8 Rain Countermeasure No. 1-2 Tsutsui District Rainwater Storage Facility Construction
(3) Construction Location: Tsutsui, Matsumae Town
(4) Construction Outline: Submersible pump φ150 N=2 units; Control panel related N=1 set.
(5) Construction Period: From the day after the contract is concluded (or the day the Matsumae Town Assembly resolves, if it falls under the provisions of Article 2 of the Ordinance on Contracts and Acquisition or Disposal of Property Subject to Assembly Resolution (promulgated March 30, Showa 39)) until March 23, Reiwa 9.
(6) Estimated Price: To be announced after the fact.
(7) Minimum reserve price system will be applied. The calculation formula will be based on the "Investigation Standard Price or Minimum Reserve Price (including factory production)" defined by Ehime Prefecture, and will be the sum of those calculated for each work type.
2. Bidding Method
(1) This project will be executed through the electronic bidding system (hereinafter referred to as the "electronic bidding system") as defined in the Matsumae Town Electronic Bidding Operation Standards (promulgated December, Reiwa 5).
(2) If bidding by paper is unavoidable due to unavoidable reasons, submit the Paper Bid Participation Acceptance Request (Operation Standards Form No. 6) or the Paper Bid Transition Acceptance Request (same form No. 7) and obtain approval as follows:
a. Submission Period: Must arrive by the end of business hours on October 2, Reiwa 8 (Friday) (Business hours as defined in Article 2 of the Matsumae Town Business Hours Regulations (March 10, Reiwa 7, Regulations No. 2). The same applies hereinafter).
b. Submission Location: 16 Inquiries
(1) Department in charge: Treasury Bureau, Accounting Division, Contract Section (hereinafter referred to as the "Contract Section").
c. Submission Method: In person or by mail (hereinafter referred to as "mail, etc.").
3. Qualifications of Bidders
Bidders must meet all of the following requirements as of the day before the announcement date of this project:
(1) Must be a single company.
(2) Must have obtained a construction industry permit under Article 3, Paragraph 1 of the Construction Industry Act (Law No. 100 of Showa 24) and a permit for the type of construction work specified in Paragraph 2 of the same Article, specifically "Machinery and Equipment Installation Construction."
(3) Must be registered in the list of qualified contractors stipulated in Article 148, Paragraph 4 of the Matsumae Town Financial Regulations (Showa 62, Matsumae Town Regulations No. 2) for Machinery and Equipment Installation Construction, and must have their head office, branch, or business office located "within Shikoku," with a rating of A or B.
(4) Must be able to assign a full-time chief or supervising engineer who meets the following requirements. However, this does not apply if the proviso to Article 26, Paragraph 3 of the Construction Industry Act is met.
a. For chief engineers, must meet one of the requirements of Article 7, Paragraph 2, items (b) to (d) of the Construction Industry Act regarding machinery and equipment installation construction.
b. For supervising engineers, must meet Article 15, Paragraph 2, item (a) of the Construction Industry Act and have completed supervising engineer training.
c. Must have a continuous employment relationship of 3 months or more with the bidder at the time of the bid participation application.
(5) Must not be within the period of suspension of bidding qualification based on the Matsumae Town Regulations on Suspension of Bidding Qualification (Reiwa 23, Matsumae Town Public Notice No. 10).
(6) Must not have filed for commencement of rehabilitation proceedings under the Corporate Reorganization Act (Law No. 154 of Reiwa 14) or commencement of rehabilitation proceedings under the Civil Rehabilitation Act (Law No. 225 of Heisei 11). (Excluding those who have received a decision to approve a rehabilitation plan under the Corporate Reorganization Act or a rehabilitation plan under the Civil Rehabilitation Act).
(7) Must not fall under the provisions of Article 167-4, Paragraph 1 of the Local Autonomy Act.
(8) Must have undergone a business performance review as stipulated in Article 18-2 of the Construction Industry Act Enforcement Regulations (Showa 24, Ministry of Construction Ordinance No. 14).
(9) There must be no relationship between bidders that falls under any of the following criteria. However, if there is a relationship, contacting parties to decide who will withdraw shall not be considered collusion or other illegal acts.
a. Capital relationship
(a) When there is a relationship between a subsidiary, etc. (meaning a subsidiary, etc. as defined in Article 2, Item 3-2 of the Companies Act. The same applies in (b)) and a parent company, etc. (meaning a parent company, etc. as defined in Article 2, Item 4-2 of the same Act. The same applies in (b)).
(b) When there is a relationship between subsidiaries, etc. that share the same parent company, etc.
b. Personnel relationship
(a) When an officer of one company, etc. (meaning a company, etc. as defined in Article 2, Item 3-2 of the Enforcement Regulations of the Companies Act. The same applies hereinafter) is concurrently serving as an officer of the other company, etc. However, this does not apply if one of the companies, etc. is a company undergoing rehabilitation proceedings as defined in Article 2, Item 4 of the Civil Rehabilitation Act or a company in reorganization (meaning a company in reorganization as defined in Article 2, Item 7 of the Corporate Reorganization Act).
a. Directors of a stock company. However, the following are excluded:
① Directors who are audit committee members in a company with an audit and supervisory committee system as defined in Article 2, Item 11-2 of the Companies Act.
② Directors in a company with a nominating committee, etc. system as defined in Article 2, Item 12 of the Companies Act.
③ Outside directors as defined in Article 2, Item 15 of the Companies Act.
④ Directors who are not to execute business pursuant to the provisions of the articles of incorporation as stipulated in Article 348, Paragraph 1 of the Companies Act.
b. Executive officers of a company with a nominating committee, etc. system as defined in Article 402 of the Companies Act.
c. Members of a company with an unlimited liability partnership, limited partnership, or limited liability company (meaning a general partnership company, a limited partnership company, or a limited liability company) as defined in Article 575, Paragraph 1 of the Companies Act (excluding members who are not to execute business pursuant to the provisions of the articles of incorporation as stipulated in Article 590, Paragraph 1 of the same Act).
d. Directors of a partnership.
e. Others who execute business and are deemed to have equivalent or greater control than those listed in a to d.
(b) When an officer of one company, etc. is concurrently serving as a trustee appointed under Article 64, Paragraph 2 of the Civil Rehabilitation Act or Article 67, Paragraph 1 of the Corporate Reorganization Act for the other company, etc.
(c) When a trustee of one company, etc. is concurrently serving as a trustee of the other company, etc.
(10) Bidders or their officers, etc. (meaning employees who execute business, directors, executive officers, or those equivalent to them, or advisors, consultants, or any person with any title who is deemed to have control equivalent to or greater than employees who execute business, directors, executive officers, or those equivalent to them for a corporation) must not be any of the following:
a. Persons falling under Article 2, Items 1 to 3 of the Matsumae Town Anti-Boryokudan Act (Reiwa 23, Matsumae Town Ordinance No. 13) (hereinafter referred to as "Boryokudan members, etc.").
b. Persons who have not completed 5 years since ceasing to be Boryokudan members, etc.
c. Persons whose business activities are controlled by Boryokudan members, etc. or persons listed in b.
4. Inspection of Drawings, etc.
(1) Available for viewing within the bidding information disclosure system until 5:00 PM on October 2, Reiwa 8 (Friday).
(2) For those who wish to borrow drawings, etc., they will be lent recorded on electronic media (CD). In this case, they must be returned by mail, etc. by 5:00 PM on October 2, Reiwa 8 (Friday).
5. Questions and Answers Regarding Drawings, etc.
(1) Those who have questions regarding the drawings, etc. may submit a Question and Answer Form (Operation Standards Form No. 3 of the Post-Bid Examination Type General Competitive Bidding Implementation Guidelines (Reiwa 22, Matsumae Town Public Notice No. 30); hereinafter referred to as "Guidelines") using the electronic bidding system, or submit them to the Contract Section via email or mail, etc.
(2) The period for submitting questions is until 5:00 PM on September 24, Reiwa 8 (Thursday).
(3) Bidders who submit questions via the electronic bidding system or email must contact the Contract Section by phone, etc. to inform them.
(4) Answers to questions will be provided via the bidding information disclosure system by 5:00 PM on September 29, Reiwa 8 (Tuesday). Please be sure to check before bidding.
6. Procedures for Post-Bid Examination Type General Competitive Bidding
(1) Submission of Bid Form and Construction Cost Breakdown
a. For electronic bidding: Submit the bid form and construction cost breakdown (write the amount for each construction category and type of work in the "Construction Cost Breakdown (Sample)". If the content is the same, other formats are acceptable. The same applies hereinafter) via the electronic bidding system between 9:00 AM on September 30, Reiwa 8 (Wednesday) and 5:00 PM on October 2, Reiwa 8 (Friday).
b. For paper bidding: Submit the bid form (Financial Regulations Form No. 52) along with the construction cost breakdown to the Contract Section by mail, etc., to arrive by the end of business hours between 9:00 AM on September 30, Reiwa 8 (Wednesday) and 5:00 PM on October 2, Reiwa 8 (Friday). The bid form and construction cost breakdown must be sealed separately, with "Bid Item Name," "Bidder Name," and "Bid Form" or "Construction Cost Breakdown" written on the respective envelopes.
(2) Bidders must write the amount excluding consumption tax and local consumption tax in the bid form, regardless of whether they are taxable or exempt from consumption tax and local consumption tax.
(3) The number of bid executions is limited to two. The opening of bids for re-bidding will be on the day after the first bid opening (excluding Saturdays, Sundays, and holidays. The same applies hereinafter). The bid deadline and opening time will be notified via the electronic bidding system. The same applies if the bid opening date is changed due to circumstances. A breakdown must also be submitted for re-bids.
7. Date and Time and Place of Bid Opening
Date and Time: 3:00 PM on October 5, Reiwa 8 (Monday)
Place: Large Conference Room (Middle) on the 2nd floor of Matsumae Town Hall or Accounting Division Office
Bidders who wish to do so may attend the bid opening. In that case, contact the Contract Section by the day before the bid opening date. Paper bidders must attend the bid opening.
Bids from bidders found to be unqualified before the bid opening will not be opened.
8. Determination of Successful Bid Candidate
(1) The successful bid candidate will be determined by ranking from the lowest valid bid within the range of the estimated price.
(2) If there are two or more successful bid candidates, they will be selected in order by lot using the electronic lottery system.
9. Documents to be Submitted After Bid Opening
Successful bid candidates must submit all of the following documents (one copy each) via the electronic bidding system within business hours on the day after the bid opening. If the capacity of the electronic file exceeds 3 megabytes, or if submitting by paper, submit by facsimile, email, or in person. Failure to submit will result in disqualification.
(1) Copy of construction industry permit notification or permit certificate (most recent).
(2) Copy of business scale evaluation result notification/overall assessment value notification (most recent).
(3) Report of assigned technical personnel (Guidelines Form No. 4).
(4) Supporting documents that confirm the content of the preceding item.
(5) For those who have filed for commencement of rehabilitation proceedings under the Corporate Reorganization Act or commencement of rehabilitation proceedings under the Civil Rehabilitation Act, a document certifying the decision to approve the rehabilitation plan under the Corporate Reorganization Act or the rehabilitation plan under the Civil Rehabilitation Act.
10. Method of Determining the Successful Bidder
(1) If the successful bid candidate meets all the bid participation qualification requirements, they will be determined as the successful bidder.
(2) If a successful bidder is not determined, the next ranked successful bid candidate will be examined sequentially to determine the successful bidder.
11. Explanation of Reasons for Not Being Determined as Successful Bidder
(1) Successful bid candidates who were not determined as the successful bidder may request an explanation of the reasons in writing from the town. In this case, the written request must be submitted by mail, etc. to the Contract Section within business hours within 7 days (excluding holidays) from the day after the notification date.
(2) A response to the person who submitted the document in (1) will be provided in writing within 10 days (excluding holidays) from the day after the date of receipt of the document.
12. Bid Bond and Contract Deposit
(1) Bid Bond: Exempt.
(2) Contract Deposit: Must pay a deposit of 10% or more of the contract amount. However, this can be substituted by negotiable securities, a guarantee from a financial institution or guarantee company, a public works performance guarantee bond, or the conclusion of a performance guarantee insurance contract.
13. Matters Regarding Invalid Bids
A bid will be deemed invalid if it falls under any of the following:
(1) Falls under Article 158 of the Financial Regulations.
(2) Violates the terms and conditions of the bid.
(3) The amount on the submitted bid form differs from the amount on the construction cost breakdown.
14. Payment Terms
(1) Advance Payment: Within 4/10 of the contract amount, to be made in accordance with Article 185 of the Financial Regulations.
(2) Intermediate Advance Payment: Within 2/10 of the contract amount, to be made in accordance with Article 185-2 of the Financial Regulations.
(3) Partial Payment: To be made in accordance with Article 184 of the Financial Regulations, only if partial payment is chosen instead of intermediate advance payment.
15. Other
(1) The successful bid price will be the amount indicated on the successful bidder's bid form, plus the corresponding amount of consumption tax and local consumption tax (if there is a fraction of less than 1 yen, it will be rounded down).
(2) Conclusion of Contract, etc.
a. If the successful bidder no longer meets any of the bid participation qualification requirements between the determination of the successful bidder and the conclusion of the contract, the contract will not be concluded. In this case, the successful bidder will be determined by examining the bid participation qualification requirements of the next ranked successful bid candidate.
b. If collusion or other illegal acts are discovered in this bid, the contract may be canceled.
c. If an incident occurs that is deemed to have a significant social impact, such as the arrest of an officer of the successful bidder in this bid, the contract may be canceled.
(3) Site inspections will not be conducted.
(4) The cost of preparing and submitting documents shall be borne by the submitter.
(5) Submitted documents will not be returned.
(6) This bid is valid even if only one bid is submitted.
(7) This construction work is subject to the initiative to secure two days off per week. Implementation methods and other handling will be in accordance with the provisions of the "Trial Implementation Guidelines for Securing Two Days Off Per Week Construction Work, etc." (Reiwa 7, Matsumae Town Public Notice No. 35).
