Service of disposal of biodegradable municipal waste

Waste disposal service: • KBO 20 02 01: biodegradable waste – at the Supplier's location, the Customer's own transport. The subject of the procurement is the procurement of the service of disposal or taking over for further recovery of non-hazardous waste with the associated key number KBO 20 02 01 - biodegradable waste, in accordance with the Ordinance on Waste Management (Official Gazette, number 106/22), which the Customer has collected in the territorial area of public service provision from public service users during the performance of municipal waste management activities. Biodegradable municipal waste is non-hazardous waste generated in households and waste that is similar in nature and composition to household waste, except for production waste and waste from agriculture, forestry, which contains biodegradable waste in its composition. The selected supplier undertakes to: - ensure waste weighing; - ensure waste treatment; - dispose of the taken waste in the manner prescribed by law. The offered service of the subject of procurement must enable the taking over and further treatment of waste in accordance with the Waste Management Act (Official Gazette, number 84/21 and 142/23 – hereinafter referred to as the Waste Management Act) and subordinate regulations. The Customer's responsibility on any basis for the waste that is the subject of this procedure ceases at the moment of taking over the waste by the authorized person of the Contractor, i.e., after the Contractor takes over the waste in the manner prescribed by the Waste Management Act. The Customer undertakes to take reasonable measures to avoid mixing other types of waste and impurities with the waste that is the subject of the procurement, and the service provider undertakes to take it over in the condition and quantities and in the manner described. Each shipment of waste must be accompanied by legal accompanying documentation, and the Customer undertakes to hand over a duly completed and certified Waste Accompanying Sheet – form PL-O to the Contractor upon each delivery of waste, all in accordance with the Waste Management Act and subordinate regulations. A copy of the accompanying sheet certified by the Customer and the economic entity providing the waste collection and disposal service are proof of service execution. The Customer is not responsible for any omissions by the economic entity – service provider, or damages caused to third parties.
