3.3. Contracting Authority's requirements regarding the subject of the order: 1) the offered medical device must have approvals, certificates and be registered in accordance with the legal provisions requiring approvals, certificates and registration, 2) the offered medical device must be introduced into circulation and use in accordance with the requirements of the Act of April 7, 2022, on Medical Devices (Journal of Laws of 2024, item 1620, as amended), 3) the offered medical device must comply with the standards or technical specifications applicable to this device; In cases where the offered medical device does not require notification to the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products, the Contractor is obliged to perform, at their own expense and at their own cost, all actions necessary to fulfill all legal requirements related to the introduction of the device into circulation and use in the territory of the Republic of Poland. The Contractor is obliged to perform such actions within the deadlines resulting from the applicable regulations and to provide the Contracting Authority with appropriate documents confirming the performance of such actions within these deadlines. 3.4. In cases where trademarks, patents or origin, source or specific process characterizing specific products or services provided by a specific contractor are indicated in the description of the subject of the order, it means that the Contracting Authority cannot describe the subject of the order in a sufficiently precise and understandable way, however, in each such situation, the Contracting Authority allows for an equivalent solution to those described above. In such cases, any indications of trademarks, patents, origin, source or specific process characterizing specific products or services provided by a specific contractor should be read together with the words "or equivalent". When describing the subject of the order by referring to standards, technical assessments, technical specifications and systems of technical references referred to in Art. 101 sec. 1 point 2 and sec. 3, the Contracting Authority allows for solutions equivalent to those described. In such cases, any indications should be read together with the words "or equivalent". 3.5. The Contracting Authority requires the performance of the subject of the order on the terms specified in the agreements. The projected provisions of the public procurement agreement, which will be introduced into the agreement, constitute attachments to the SWZ. 20. INFORMATION ON INTENDED ORDERS REFERRED TO IN ART. 214 PARAGRAPH 1 POINTS 7 AND 8, IF THE CONTRACTING AUTHORITY INTENDS TO AWARD SUCH ORDERS The Contracting Authority does not intend to award orders referred to in Art. 214 Paragraph 1 Point 7 of the Pzp Act. The Contracting Authority does not intend to award orders referred to in Art. 214 Paragraph 1 Point 8 of the Pzp Act. DESCRIPTION OF THE CRITERIA THE CONTRACTING AUTHORITY WILL USE TO SELECT THE OFFER, INCLUDING THE WEIGHTS OF THESE CRITERIA AND THE METHOD OF EVALUATING OFFERS 13.1. The offers will be evaluated based on the criteria specified in the SWZ and their weights. Offers will be evaluated on a point basis separately for individual Tasks. During the evaluation of offers, subsequent offers considered and evaluated will be awarded points for the following criteria according to the following rules: PRICE CRITERION weight: 60% PARTIAL ORDER COMPLETION DEADLINE CRITERION weight: 20% (Tn) QUALITY CRITERION weight: 20% (Bn)
