I. The execution of the subject of the procurement for this lot includes: 1. Performing technical inspections (preventive maintenance) of air conditioning and ventilation equipment upon request from the Contracting Authority through the main contract coordinator, and includes activities necessary for the normal and correct operation and operating modes of the air conditioning equipment, as indicated in Section II, Item 1 of the Technical Specification of the procurement. When performing technical inspections (preventive maintenance), the Contracting Authority pays for the work performed by type and number of serviced equipment at the prices offered in the price proposal. 2. Performing repairs of air conditioning and/or ventilation equipment - as needed. Repair activities include fixing malfunctions identified by the contractor during technical inspections or upon notification by the contracting authority, including fixing software-related errors. 3. Emergency repairs - in case of need for emergency repair of malfunctions and emergencies of an urgent nature, the Contractor is obliged to respond within the deadlines specified by the Contracting Authority, as detailed in the Technical Specification. The cost of labor for preventive maintenance, upkeep, technical servicing and/or repair of air conditioning equipment and for fixing malfunctions and defects is borne by the Contracting Authority. The cost is determined based on the prices offered by the participant in their price proposal, with the price for preventive maintenance being per unit depending on the type of equipment, and for repairs - on an hourly rate (Euro per man-hour) for the labor invested, depending on the actual man-hours worked, necessary for carrying out the activities under this public procurement. 4. Supply of spare parts, materials and consumables: In case of need for spare parts, materials and consumables, the Contractor undertakes to provide the necessary ones by first submitting a request/offer to the main contract coordinator designated by the Contracting Authority, containing the quantities and prices of the spare parts required for replacement, and to proceed with the repair activities and the use of consumables after the request/offer has been approved by the main contract coordinator. The cost of spare parts, materials and consumables is borne by the Contracting Authority and is paid at supply prices (acquisition price by the Contractor), with the exception of those indicated in Item III of the participant's price proposal, which the participant has offered and which are not subject to change during the entire contract period. All costs for purchased spare parts, materials and consumables incurred without the approval of the Contracting Authority are borne by the Contractor, and the Contracting Authority is not obliged to pay for them. II. The costs are foreseen as an unsecured commitment and unsecured financial resource under Art. 114 of the Public Procurement Act. The contract for lot No. 1 is with deferred execution - until funding for the public procurement is secured and is valid until December 31, 2029. If a contract for the execution of the procurement is concluded, execution begins after confirmation from the CONTRACTING AUTHORITY that funding has been secured and the contractor has provided the specified performance guarantee. After the conclusion of the contract, either party may request its termination without notice, after a three-month period from its conclusion, if funding has not been secured within this period. When funding has not been secured after a 10-month period from the conclusion of the contract, the contract is considered terminated.
