Original language: bgСъгласно чл. 15, ал. 4 от ПТЕЕ договорите по цени, определени по одобрена от КЕВР методика, се сключват между доставчиците от последна инстанция и крайни клиенти, които не са избрали друг доставчик на електрическа енергия или са останали без доставчик, при публично известни общи условия, които влизат в сила за крайните клиенти без изрично писмено приемане, считано от датата, на която обектът на съответния краен клиент е прехвърлен в балансиращата група на доставчика от последна инстанция. Доставчик от последна инстанция (ДПИ) е лице, на което е издадена лицензия съгласно Закона за енергетиката и доставя електрическа енергия в случаите, когато основният доставчик по силата на договор за покупко-продажба или на договор за комбинирани услуги не е в състояние да продължи да извършва доставка поради обявяване в несъстоятелност, ликвидация, отнемане на лицензия, отстраняване от пазара, прекратяване на договора за доставка или всякакво друго събитие, довело до временно или трайно преустановяване на доставката на електрическа енергия, както и на крайни клиенти, които не могат да бъдат клиенти на крайния снабдител до избора на друг доставчик (чл. 104, ал. 1 от ПТЕЕ). Целта на поръчката е сключването на договор с ДПИ по смисъла на чл. 104, ал. 1 от ПТЕЕ, който временно да доставя електрическа енергия на обекти – държавна собственост, стопанисвани и управлявани от НСО, присъединени към електроразпределителната мрежа на съответния оператор – лицензиант на съответната обособена територия в случаите, когато: - избраният от НСО основен доставчик на свободен пазар не е в състояние да продължи да извършва доставката на електрическа енергия, поради независещи от крайния клиент причини, вкл. обявяване в несъстоятелност, ликвидация, отнемане на лицензия, отстраняване от пазара, прекратяване на договора за доставка или всякакво друго събитие, довело до временно или трайно преустановяване на доставката на електрическа енергия; - Националната служба за охрана, като краен клиент, не е избрала основен доставчик на електрическа енергия на свободен пазар – за времето до избора на такъв.
