For these, services will be provided in accordance with the partnership model described in the attached home care service description of Kainuu Welfare Area.
The procurement involves a partial business transfer. The subject of the business transfer is the functional entity related to the service production covered by the procurement, as well as the transferring personnel defined separately in the business transfer agreement. The final number of transferring personnel will be determined according to the situation at the time of the business transfer. A partial business transfer will be agreed upon by a separate business transfer agreement. This is a business transfer as referred to in Chapter 1, Section 10 of the Employment Contracts Act (55/2001). In connection with the business transfer, the personnel primarily belonging to the service production covered by the procurement will transfer to the service of the selected service provider as so-called old employees in accordance with the principles of business transfer. The rights and obligations related to the employment relationships of the transferring employees will transfer to the recipient of the business transfer at the time of transfer in accordance with current legislation. The service provider is responsible for employer obligations related to the transferring personnel after the transfer.
The partial business transfer agreement will provide anonymized information necessary for tender calculation regarding the transferring personnel. The information will be presented in a way that individual employees cannot be identified. After the procurement decision, the selected service provider will be provided with the individualized personnel information necessary for the preparation of the business transfer according to a separately agreed schedule. The transfer of information will take place in accordance with current data protection legislation, labor data protection regulations, and legislation concerning business transfers.
Bidders must note that for the transferring personnel, the criteria mentioned in the procurement object criteria, section personnel and competence, are absolute minimum requirements for the procurement object and their fulfillment is mandatory; and in the future, if the service provider recruits personnel, the recruited personnel must meet the requirements of the tender request.
Detailed terms and information regarding the transferring personnel will be defined in the partial business transfer agreement attached to the tender request.
