Original language: hrPredmet nabave je nabava usluge preuzimanja na daljnju oporabu neopasnog otpada KBO 20 01 08, a sukladno Dodatku X, KATALOG OTPADA, Pravilnika o gospodarenju otpadom (NN 106/22,138/24) i Zakonu o gospodarenju otpadom (NN 84/21, 142/23), članak 4. stavak 1. točka 37., a kojeg je naručitelj prikupio na teritorijalnom području pružanja javne usluge od korisnika javne usluge prilikom obavljanja djelatnosti gospodarenja otpadom. Biootpad je biološki razgradiv otpad iz vrtova i parkova, hrana i kuhinjski otpad iz kućanstava, restorana, ugostiteljskih i maloprodajnih objekata i slični otpad iz prehrambene industrije sukladno članku 4. stavak 1. točka 3. Zakona o gospodarenju otpadom (NN 84/21, 142/23). Biorazgradivi otpad je svaki otpad ili dio otpada koji podliježe anaerobnoj ili aerobnoj razgradnji, kao što je otpad iz vrtova, otpad od hrane te papir i karton. Biootpad nije predviđen za odlaganje na odlagalište sukladno članku 39. stavak 1. točka 9. Zakona o gospodarenju otpadom (NN 84/21, 142/23). „Na odlagalištu otpada zabranjeno je odlaganje odvojeno sakupljenog otpada u svrhu pripreme za ponovnu uporabu i recikliranje sukladno članku 22. ovoga Zakona, osim otpada koji nastaje obradom odvojeno sakupljenoga otpada za kojega odlaganje daje najbolji ishod za okoliš sukladno hijerarhiji gospodarenja otpadom.“
