Direct procurement for financial planning system

Päijät-Häme wellbeing services county uses the Clausion Financial Performance Management (also system) financial planning system. Meidän IT ja Talous Oy (Meita) has procured the financial planning system according to the Act on Public Procurement and Concession Contracts (1397/2016, Procurement Act) as a procurement procedure, based on which insightsoftware Finland Oy has been selected as the system supplier. Päijät-Häme wellbeing services county has made significant investments in the implementation and development of the system, which is in the early stages of its lifecycle, since 2023. As a result, the system has become an integral part of the operating environment, has increased supplier-specific expertise, and includes interoperability requirements with other systems. Päijät-Häme wellbeing services county acquired the system from Meita based on the decision of the interim preparatory body of Päijät-Häme wellbeing services county on 18.01.2022 § 6, based on the related unit status according to the Procurement Act. With the reform of the Procurement Act, the related unit status will cease. The procurement procedure will be carried out as a direct procurement in accordance with Section 40 of the Procurement Act, in which the contracting authority negotiates the terms of the procurement contract with the selected supplier without prior publication of a procurement notice. The basis for direct procurement is the ground referred to in Section 40, Paragraph 2, Clause 2 of the Procurement Act: for technical reasons or reasons related to the protection of exclusive rights, only a specific supplier can carry out the procurement; an additional condition is that there are no reasonable alternative or substitute solutions and that the lack of competition is not due to the artificial narrowing of the procurement conditions. Päijät-Häme wellbeing services county has used a significant amount of resources to develop the current system. The development work has increased the expertise of the current system supplier regarding the specific needs of the wellbeing services county so that the system meets the required performance level. Achieving the required performance level for a new system would require a significant amount of resources from the contracting authority, which the wellbeing services county does not have available for system development. For the reasons mentioned above, there are no reasonable alternative solutions. In accordance with Section 2, Paragraph 2 of the Procurement Act, contracting authorities must strive to organize their procurement activities in such a way that procurements can be carried out as economically, high-quality, and systematically as possible. In addition, the section requires the utilization of existing competitive conditions, which were taken into account in Meita's original procurement. Päijät-Häme wellbeing services county has negotiated with Meita and insightsoftware Finland Oy regarding the procurement and continuation of the use of the current system environment.
