1. Acceptance of Terms
By accessing or using BidsFactory (the "Service"), operated by Aninver Development Partners, S.L., you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Service.
2. Description of the Service
BidsFactory is a platform that aggregates public tender opportunities from more than 310 official sources in 207 countries, lets registered users save tenders and create email alerts, and offers a companies and awards directory.
3. User accounts
3.1 Registration
To access certain features, you must register for an account. You agree to provide accurate, current and complete information during registration and to keep it up to date.
3.2 Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.
4. Subscription plans
4.1 Free and paid plans
The Service offers a free plan and paid plans (Individual, Team and Enterprise). Paid plans unlock additional features as described on the pricing page.
4.2 Billing and renewal
Paid subscriptions are billed in advance, monthly or annually. Subscriptions renew automatically unless cancelled before the renewal date. You can cancel at any time from your account settings.
4.3 Refunds
New subscribers have a 14-day money-back guarantee on their first charge. After that window, subscription fees are non-refundable except where required by law.
5. User content
5.1 Your content
You retain ownership of the content you submit to the Service (saved searches, alert definitions, company claim requests). By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce and display that content as necessary to provide the Service.
5.2 Prohibited content
You agree not to submit content that:
- Is false, misleading or fraudulent
- Infringes on intellectual-property rights
- Contains malware or harmful code
- Violates any applicable law or regulation
- Is defamatory, obscene or offensive
6. Tender information
Tender information on the Service is aggregated from public sources for informational purposes only. We make reasonable efforts to ensure accuracy but do not guarantee the completeness or freshness of any specific listing. Always verify information with the official source before making business decisions.
7. Intellectual property
The Service — including its design, features and content (excluding user content) — is owned by Aninver Development Partners, S.L. and protected by intellectual-property laws. You may not copy, modify, distribute or create derivative works without our express written permission.
8. Limitation of liability
To the maximum extent permitted by law, BidsFactory and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business opportunities, arising from your use of the Service.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure or error-free.
10. Indemnification
You agree to indemnify and hold harmless BidsFactory and its affiliates from any claims, damages, losses or expenses arising from your use of the Service or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination your right to use the Service will immediately cease.
12. Governing law
These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts of Málaga, Spain.
13. Changes to the Terms
We may modify these Terms at any time. We will notify users of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
